The client (Plaintiff), a general construction company, received ownership of a commercial unit from a developer (Defendant 2) as an accord and satisfaction for outstanding construction payments. However, the existing tenant of the unit (Defendant 1) repeatedly failed to pay the rent, prompting the client to retain our firm to recover the unpaid lease payments. After a thorough legal review, we determined the competent court and filed the lawsuit with the Seoul Central District Court. Upon receiving the service of process, the defendants raised no objections regarding jurisdiction, and Defendant 1 duly submitted an answer to the said court, participating in the proceedings.
2. The Court’s Ex Officio Transfer Order and Its Implications
During the proceedings, however, the Seoul Central District Court unexpectedly issued an ex officio order to transfer the case to the Seongnam Branch of the Suwon District Court. The court provided no specific reasoning other than a brief statement that the case "does not fall under the jurisdiction of this court." This ex officio transfer was legally questionable given that jurisdiction was properly established and both parties had already engaged in the merits of the case. Furthermore, transferring the case would inevitably cause a delay of at least two to three months due to reassigning the judicial panel and forwarding records, severely jeopardizing the client's right to a speedy trial.
3. Immediate Appeal and Court’s Reversal Decision
To minimize any procedural disadvantage to our client, we promptly filed an Immediate Appeal with the Seoul Central District Court. In the appeal, we presented a rigorous legal argument demonstrating that the Seoul Central District Court holds proper jurisdiction, that proprietary jurisdiction had been established by the parties' appearance, and that there was no necessity for a transfer. Accepting our arguments in their entirety, the Civil Appellate Division of the Seoul Central District Court ruled to reverse the original transfer order approximately one and a half months after the filing. The court explicitly noted in its decision that none of the parties desired the transfer, thereby confirming that the case would proceed at the Seoul Central District Court.
