The client had maintained a marriage for approximately nine years while primarily handling childcare and household responsibilities. However, due to the spouse’s long-term extramarital affair, repeated alcohol abuse, and verbal abuse, the marital relationship became irreparably damaged, leading to divorce proceedings involving property division and child custody issues.

The primary issues in this case involved proving the spouse’s misconduct, determining the contribution ratio for property division, and resolving custody and child support matters. Although the opposing party earned a significantly higher income, the client argued that her continuous contributions to childcare, household management, and maintenance of the family environment played a substantial role in the formation and preservation of marital assets.

Attorney Yang Yumi presented objective evidence, including messenger conversations, photographs, and accommodation records, to demonstrate that the spouse’s misconduct had continued over an extended period. The attorney also organized evidence regarding repeated verbal abuse and alcohol-related issues as major causes of the breakdown of the marriage. The court found that the spouse’s adultery and verbal abuse constituted grounds for divorce and ordered the payment of KRW 25 million in alimony. Despite the income disparity between the parties, the court recognized the client’s substantial contributions to childcare and household responsibilities and acknowledged a 50% contribution to marital property. The client was also granted sole parental authority and custody, with monthly child support of KRW 900,000 awarded until the child reaches adulthood.
