Case Summary:

Suhn Law Group successfully facilitated an amicable divorce in a case where the opposing party (husband) initially refused to agree, while also reaching agreements on property division, child custody, and child support in favor of the client (wife).

Although the client initially sought litigation, the firm advised that (1) it would be difficult to establish statutory grounds for judicial divorce, particularly regarding marital misconduct, and (2) considering the post-divorce relationship between the husband and the child, including child support, an amicable divorce would be more appropriate. Based on this, the case was resolved through mutual agreement.

The marital relationship had already broken down due to the husband’s excessive drinking, economic control, and neglect of household responsibilities and childcare, to the extent that the client had attempted self-harm. The situation further deteriorated when the client discovered the husband’s visits to adult entertainment establishments, leading to a complete loss of trust and the decision to divorce.

However, the available evidence regarding alleged misconduct was insufficient to clearly establish fault under judicial divorce standards. In addition, concerns about custody and the potential impact on the child’s relationship with the father made it preferable to avoid further conflict and proceed with an amicable resolution.
